1. Acceptance of Terms

By downloading, installing, or using MyDailyTally ("the App"), you agree to these Terms of Service. If you don't agree with any part of these terms, please don't use the App.

These terms apply to the MyDailyTally mobile application developed by Workhorse Solutions LLC.

2. Description of Service

MyDailyTally is a habit tracking and intermittent fasting app that helps users build and maintain daily routines. Key features include:

• Habit tracking with streak counting and forgiveness modes
• Intermittent fasting timer with metabolic zone tracking
• Local data storage (no cloud sync)
• Customizable habit settings and reminders
• Free tier with limited features
• Optional Premium subscription for unlimited features

3. License and Permitted Use

We grant you a personal, non-transferable, non-exclusive license to use MyDailyTally for your personal habit tracking and wellness goals.

You May:

• Install and use the App on your personal iOS devices
• Track your habits, fasting sessions, and wellness data
• Share general information about the App with others
• Export your personal data (Premium feature)

You May Not:

• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or create derivative works of the App
• Distribute, sell, or sublicense the App
• Use the App for any illegal or harmful purposes
• Attempt to circumvent security measures or Premium features
• Use the App in ways that could damage our reputation or business

4. Premium Subscriptions

Subscription Terms

• Premium subscriptions are processed through Apple's App Store
• Subscriptions automatically renew unless cancelled
• Pricing is displayed in the App Store and may vary by region
• You can cancel anytime through your Apple ID account settings

Free Trial

• Premium may include a free trial period
• You can cancel during the trial without being charged
• If you don't cancel, your subscription will begin after the trial

Refunds

• Refund requests are handled by Apple, not us
• Contact Apple Support for subscription refund requests
• We cannot process refunds directly

5. User Data and Privacy

Your privacy is fundamental to how MyDailyTally works:

• All habit and fasting data is stored locally on your device
• We do not collect, access, or store your personal data
• We cannot see your habits, fasting sessions, or usage patterns
• Data is not transmitted to our servers or third parties
• Deleting the App permanently removes all your data

6. Medical Disclaimer

Important: MyDailyTally is not a medical app and should not be used for medical purposes.

• The App is for general wellness and habit tracking only
• Fasting features are informational, not medical advice
• Consult a healthcare provider before starting any fasting regimen
• Do not use the App to diagnose, treat, or prevent medical conditions
• We are not responsible for any health consequences of using the App

7. Limitation of Liability

MyDailyTally is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any damages arising from use of the App
• We do not guarantee the App will be error-free or always available
• You use the App at your own risk
• Our total liability is limited to the amount you paid for Premium (if any)

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

8. App Store Terms

MyDailyTally is distributed through Apple's App Store and is subject to Apple's Terms of Service in addition to these terms. In case of conflict between these terms and Apple's terms, Apple's terms take precedence.

Apple is not responsible for the App or these terms, and any claims should be directed to us, not Apple.

9. Updates and Changes

App Updates

• We may release updates to improve features and fix bugs
• Updates are optional but recommended for the best experience
• Some updates may require accepting new terms

Terms Changes

• We may update these terms occasionally
• Significant changes will be announced through the App Store
• Continued use of the App constitutes acceptance of new terms
• If you disagree with changes, you can stop using the App

10. Termination

You Can:

• Stop using the App anytime by deleting it
• Cancel Premium subscriptions through Apple

We Can:

• Stop providing the App if necessary
• Remove the App from the App Store
• Terminate these terms with reasonable notice

Since all data is stored locally on your device, termination does not affect your existing data unless you delete the App.

11. Intellectual Property

MyDailyTally, including its design, code, features, and content, is owned by Workhorse Solutions LLC and protected by copyright and other intellectual property laws.

You retain ownership of your personal data, but since we don't have access to it, this is primarily academic.

Severability

If any part of these terms is found to be unenforceable, the remaining parts will continue to apply.
